Apartment Search Service Agreement

Introduction

Blind Move Charlotte, LLC is a licensed brokerage, designated as #C41823. Blind Move specializes in apartment locating and rental referral services for Clients seeking residential properties within certain locations in North Carolina. By accessing or utilizing blindmoveclt.com and its associated services, you acknowledge and agree to these Agreement, as well as to comply with all applicable laws and broker regulations governed by the North Carolina Real Estate Commission (“NCREC”). If you do not agree to these provisions of this Agreement, you are not permitted to use our website or services.

Nature of Services

Blind Move offers two tiers of service: our primary service, which incurs a non-refundable fee of $75, unless otherwise mutually agreed upon, and complimentary services that do not require a fee. Regardless of the service chosen by the Client, you understand and agree that Blind Move will be primarily compensated , our primary compensation is derived from participating apartment communities when a renter we refer signs a qualifying lease. 

It is important to note that some apartment communities may offer reduced or no referral fees. Should a property not qualify for full payment, your agent will promptly notify you prior to your visit.

All agents associated with Blind Move are licensed broker sales agents or brokers in North Carolina. Blind Move provides information and assists renters in identifying properties that align with their specified criteria. Blind Move is neither a property owner, manager, nor leasing agent for any listed properties.

Client Responsibilities

To utilize our services, you as a Client hereby agree to the following obligation:

  • Responsive: Respond to Blind Move communication within 48 hrs. 
  • Notify agent: Notify your agent prior to touring any apartment community, allowing the agent to serve as your point of contact at the property.
  • Escort-only policy: Permit agents to accompany you when visiting escort-only communities, which require locators to tour with clients.
  • Inform property: List Blind Move Charlotte, LLC as your referral source on the guest card and rental application.
  • Inform Blind Move agent: Inform agent of your signed lease within five days of signing.
  • Provide details: Give your agent necessary information for invoicing, including move date, base rent, and unit number.
  • Accuracy: Ensure all information provided throughout the rental process is accurate and truthful.
  • Transparency: Communicate directly with us regarding any changes in property details, pricing, or availability.

Accuracy of Information

We strive to maintain the accuracy of all listings, rental amounts, and promotional details. However, please be advised:

  • Property information is sourced from third parties (owners, managers, listing systems) and thus you agree that the information may not be accurate.
  • Availability, pricing, and concessions may change without notice.
  • It is your responsibility to verify all lease terms, fees, and move-in costs directly with the property prior to signing a lease.
  • Blind Move is not liable for errors, omissions, or changes made by apartment communities, and Client hereby agrees your sole responsibility to verify the lease directly with the property and covenant to do so. 

No Guarantee or Warranty

Our locating services are provided “as is and where is,” without any warranty whatsoever. We do not guarantee:

  • Approval for lease applications.
  • The quality, safety, habitability or condition of any property.
  • The accuracy or reliability of third-party listings.

All due diligence rests with you, the Client.

Third-Party Services

Blind Move’s website may include links to or integrate services from:

  • Apartment data providers
  • Utility and mover services
  • Google Maps, analytics, and advertising tools

Each third-party service is governed by its own terms and conditions, and you agree to be bound by those terms and conditions of those third party services. We do not control or assume liability for these services.

Limitation of Liability

To the fullest extent not prohibited by applicable law permitted by law, Blind Move and its affiliates shall not be liable for:

  • Lease disputes, damages, or losses arising from your tenancy
  • Errors, omissions, or service interruptions
  • Any indirect, incidental, punitive or consequential damages

You hereby agree that Blind Move’s maximum liability for any claim or loss that you sustain as a result of Blind Move’s website or services is limited to the monies  to Blind Move by you or any apartment provided commission. 

Right to Refuse Services

We reserve the right to refuse service to any Client at any time Blind Move’s sole discretion.

Privacy and Data Use

We collect and utilize data in accordance with our Privacy Policy. By using this website, you consent to:

  • Communication via phone, text, and/or email regarding your apartment search. You understand that all date rates will apply. 
  • The storage of submitted information for internal business purposes.
  • You hereby consent and agree that blind Move can provide apartment communities with Client’s name, email, phone number and any and all information you give to Blind Move. 

Laws and Regulations

This Agreement is governed by North Carolina law and you hereby agree that the courts of Mecklenburg county are the exclusive jurisdiction and venue for resolving any and all disputes between you and Blind Move. Clients agree to adhere to local, state, and federal laws, including the Federal Fair Housing Act, which protects individuals from discrimination in renting, purchasing, or securing financing for housing. Specifically, these prohibitions cover discrimination based on race, color, national origin, religion, sex, disability, and familial status. Blind Move operates under a valid North Carolina Broker License, with all agents providing locating services holding active NCREC licenses and complying with state advertising and rebate regulations. 

Communications Policy

The efficacy of our service depends on electronic communication. Blind Move employs various methods to communicate with clients, including our website, phone, letters, email, text messaging, social media, and voicemail. We aim to address our clients’ needs and concerns as efficiently and promptly as possible. 

By engaging with Blind Move, you agree to conduct business electronically and accept responsibility for monitoring and responding to electronic communications initiated by either party. You are required to use the same mode of communication to respond to us. For instance, email should be answered via email, and text messages via text, unless an alternative agreement is established. We do not guarantee responses to text messages due to the challenges associated with tracking historical text information. It is your responsibility, as well as ours, to monitor all communications and respond in a timely manner.

We encourage you to seek advice; we are obligated to respond to your inquiries but are not required to provide unsolicited advice.
